If you haven’t realized yet- I am a checklist type of agent. There are normally 3 stages of negotiations.
- Offer Stage- all the terms of the offer: price, closing date, exclusions, etc. You should submit the TAR 1945 form with your offer.
- Repair Negotiation- Per paragraph 23 in the 1-4 Family contracts in Texas, this is when you will do repair negotiations. Remember in Texas you have to deliver the option check to the seller/listing agent by 5pm on the 3rd day of option and all paragraphs in Paragraph 23 have to be filled out to have a valid option period. If you want to terminate option period, then it has to be done within the option period that was negotatied in your contract in order to get earnest money back. Your agent can guide you on that.
- Appraisal negotation- If you are submitting a VA/FHA loan offer then under the 3rd party financing it will have the value that it has to come in at. If you are doing a conventional loan in Texas than, you should use the TAR 1948 form – Addendum Concerning Right to Terminate due to Lender’s Appraisal. *** Please seek advice from Attorney on this.
